The man who pleaded guilty in the death of a West Shore Mountie last week has now been charged in a separate crash that took place the month after his initial arrest.
According to court records, Kenneth Jacob Fenton is charged with causing an accident resulting in bodily harm, impaired driving causing bodily harm and flight causing bodily harm or death in relation to a May 22, 2016 crash in the Malahat area.
The charges stemming from that incident were sworn at the Victoria Courthouse Monday.
Police told CTV News at the time they had tried to perform a late-night road check on Goldstream Heights Drive but a vehicle didn’t stop for them.
They later found the vehicle rolled over with two injured people inside, and fire officials said neither were wearing seatbelts.
That crash later resulted in a civil lawsuit against Fenton filed in September by Megan Ashe, who said she was the other passenger in the vehicle that night.
Her statement of claim said Fenton was driving with her consent when he lost control, hitting a rock and causing the vehicle to roll over.
The lawsuit alleged that Fenton was negligent because he didn’t keep a proper lookout while driving, didn’t take steps to avoid a crash, drove at an excessive rate of speed, failed to apply the brakes in time and was impaired by alcohol, drugs and fatigue.
Ashe said she sustained numerous physical injuries and was seeking unspecified damages for pain, suffering and loss of enjoyment of life.
Last week, Fenton pleaded guilty to impaired driving causing death and dangerous driving causing death in the unrelated April 5, 2016 collision that killed Const. Sarah Beckett.
Beckett, a 32-year-old wife and mother of two, was killed when Fenton’s truck slammed into her police cruiser in the intersection of Peatt Road and Goldstream Avenue in Langford.
A sentencing date will be set on June 6 for that crash, while court records indicate Fenton will appear at the Duncan Law Courts on June 27 in relation to the Goldstream Heights Drive collision.
