‘It’s frustrating’: Kitsilano Beach assault case raises questions about bail as federal reforms near

How did the accused in last week’s attack at Kitsilano Beach end up released? The answer lies in the factors courts must consider when making bail decisions.

The release of a man accused in a violent attack at Vancouver’s Kitsilano Beach has raised questions about how bail decisions are made and whether upcoming federal reforms could lead to different outcomes in future cases.

Carlos Caldera Duarte is charged with one count of assault with a weapon following an alleged attack at the beach on the afternoon of June 28 that sent a woman to hospital.

The Vancouver Police Department publicly opposed his release.

“This man committed a very violent act. He is known to us. And therefore releasing him from custody could place the public in further harm,” spokesperson Const. Darren Wong told CTV News.

Wong said police have had numerous interactions with Duarte but declined to provide further details, citing privacy concerns.

However, legal experts say bail decisions are based on a number of factors, including an accused person’s criminal history.

Court records show Duarte had no prior convictions for violent crimes.

“Anything like a prior criminal record, prior violent offences, any sort of involvement in the community in that sense would be taken into that analysis,” said criminal defence lawyer Silvia Badea.

Badea adds that the Crown must also convince the court that releasing an accused person under conditions would not adequately address any public safety concerns.

“If someone should be detained, the Crown needs to establish why there are no conditions that could alleviate them being in custody,” she said.

The B.C. Prosecution Service told CTV News that Crown counsel did not oppose Duarte’s release. Prosecutors did, however, seek several protective conditions.

Those conditions include an area restriction, a no-weapons order, and a requirement that Duarte report to both a bail supervisor and the Forensic Outpatient Clinic.

The case has also reignited debate around Canada’s bail laws.

In a statement to CTV News, Vancouver Mayor Ken Sim said the case highlights the need for stronger legislation.

“Vancouver residents deserve to feel safe in their own neighbourhoods. Cases like this reinforce why we’ve been calling for stronger bail laws,” Sim said.

Meanwhile, new federal bail reform measures are set to take effect on July 15.

The reforms are intended to place greater emphasis on public safety in certain cases involving violent crime.

In a statement to CTV News, the B.C. Ministry of Attorney General said: “These reforms focus on making sure bail decisions better reflect the real-world experiences of people, as well as imposing stronger consequences for violent offenders.”

Despite the upcoming changes, police remain frustrated with the outcome in this case.

“It’s ultimately frustrating for us as police investigators, and also maybe the public as well,” Wong said.

Duarte is scheduled to appear in court again on July 7.
