Alliston man with lengthy criminal record, released from jail for ignoring release conditions

A longtime criminal is now out of jail after pleading guilty to three counts of failing to comply with bail conditions and violating a probation order.

Longtime criminal Kody Berdan is now out of jail after pleading guilty to three counts of failing to comply with bail conditions and violating a probation order.

Berdan, 37, who is from Alliston, has a lengthy criminal record dating back about 20 years, including convictions for aggravated assault and uttering threats. He admitted to breaking his curfew and not living with his surety who bailed him out of jail last year. Police said at the time, Berdan was arrested following a bail compliance investigation.

Following his plea, Berdan apologized to the court in a letter read out by his lawyer. Berdan described a difficult upbringing and recent struggles with drugs and alcohol. He said his life was derailed when he was struck by a pickup truck in a parking lot nine years ago.

Justice Nancy Dawson accepted the joint submission from the Crown and defence, crediting Kody Berdan with time served following seven months in jail.

Berdan is ordered not to have weapons on him or communicate with, or be anywhere near, his older brother Darryl, also known as Kenny. The elder Berdan is facing drug charges that include possession for the purpose of trafficking.

The Berdan brothers were arrested several times in 2024 and 2025, accused of gun charges for which Darryl pleaded guilty and was sentenced. Several drug charges against the brothers were dropped.

Kody Berdan was mistakenly released from jail last July when he pleaded guilty to aggravated assault for breaking a man’s fingers because the man owed him money.

As part of his sentence, Kody Berdan has been placed on probation for two years. Darryl Berdan is scheduled to appear in plea court on Friday. The allegations against him have not been tested in court.
