Life sentence for 2021 bush party killing

Carlos Guerra Guerra won’t be eligible for parole for 16 years in connection with his second-degree murder conviction.

A jury handed down second-degree conviction in March.

Guerra Guerra shot and killed 18-year-old Josue Silva at a bush party in July of 2021.

The second-degree murder conviction carries a mandatory sentence of life in prison, with at least 10 years behind bars before parole.

In handing down her sentence, Justice Patricia Moore took into consideration a number of aggravating factors including the decision to attend the bush party with a gun, that he and the person he arrived with, Dylan Schaap, wore masks when they arrived and that he and Emily Altmann went back into the party to find the people she was involved in a confrontation with.

Guerra Guerra was also found guilty of aggravated assault and handed a four-and-a-half-year sentence for that offence.

He had earlier pleaded guilty obstructing justice and intimidation of witnesses.

All sentences related to those crimes will be served concurrent with the second-degree murder sentence.

Guerra Guerra will be credit approximately two years and four months for time already served.
