The Transportation Safety Board confirms it will not formally investigate a Victoria-based whale-watching company after a tour boat struck a humpback whale last week.

The Prince of Whales Whale Watching boat had 11 passengers on board when it collided with the whale near Race Rocks on Aug. 7.

The company said the whale was not observed in the area before it surfaced suddenly, causing the boat to launch off of the animal and come down hard on the water.

The whale was seen breaching after the collision and was believed to be uninjured.

Two people were sent to hospital with undisclosed injuries, one for several days until being released, while the captain suffered a minor ankle injury.

The TSB had said it was aware of the incident and was gathering information to determine if an investigation was warranted.

On Friday, the agency deemed the Aug. 7 collision a Class 5 occurrence – meaning a summary of facts will be added to a database for statistics, but it would not produce a final report on the incident.
